  1. Introduction

Please read these Terms and Conditions carefully before making a booking with us. By placing a booking, you confirm that you have read, understood, and agree to be bound by these Terms. These Terms should be read alongside our Privacy Policy.

“We”, “Us”, “Our” means Loan A Lifeguard Ltd.

“Website” means www.loanalifeguard.com.

“Client” means any individual or organisation booking lifeguarding services from us, whether acting as a consumer or in the course of business.

We reserve the right to amend these Terms at any time. The most up‑to‑date version will be published on our Website and will apply to all future bookings.

Nothing in these Terms affects your statutory rights if you are a consumer.

  1. Scope of Services

Loan A Lifeguard Ltd provides appropriately qualified lifeguards for swimming pools and water areas as agreed during the booking process (“the Lifeguarded Area”).

Our responsibility is limited to providing professional lifeguarding supervision within the Lifeguarded Area only. We do not accept responsibility for areas outside the agreed Lifeguarded Area, including but not limited to other pools, lakes, or non‑water areas at the venue.

While our lifeguards take all reasonable steps to promote safety, the Client acknowledges that participation in water activities carries inherent risks and that safety cannot be guaranteed.

  1. Client Responsibilities

The Client agrees to:

  • Provide accurate and complete information regarding the size, depth, layout, and condition of the pool or water area.
  • Declare the maximum number of swimmers expected in the water at any one time.
  • Ensure the correct number of lifeguards are booked (a minimum of one lifeguard per 30 swimmers).
  • Notify us in advance if alcohol will be available to swimmers.

Failure to provide accurate information may result in insufficient cover and may limit or exclude our liability for incidents arising directly from such inaccuracies.

If alcohol is served and has not been disclosed prior to the event, we shall not be liable for incidents directly arising from alcohol consumption.

  1. Qualifications and Staffing

All lifeguards supplied by Loan A Lifeguard Ltd hold either:

  • National Pool Lifeguard Qualification (NPLQ), or
  • National Rescue Standard (NaRS),

and hold a valid first aid qualification.

We carry out reasonable checks of qualifications and identity prior to engagement. We reserve the right to substitute lifeguards where necessary, provided replacements hold equivalent qualifications.

  1. Booking, Payment & Confirmation

For events and short‑term lifeguarding services, full payment is required in advance. A booking is only confirmed once payment has been received in full.

Upon receipt of payment, the Client will be provided with the assigned lifeguard(s)’ contact details. It is the Client’s responsibility to contact the lifeguard(s) in advance to discuss event‑specific details.

If the Client is unable to contact the lifeguard or has concerns regarding attendance, we must be notified at least 72 hours before the event start time to allow a replacement to be arranged. Failure to notify us within this timeframe may result in no refund being available.

  1. Cancellations & Refunds

All cancellations must be made in writing via email.

Refunds are applied as follows:

  • More than 7 days’ notice: full refund
  • 7 days or fewer: 50% refund
  • 72 hours or fewer: 25% refund
  • Less than 24 hours’ notice: no refund
  1. Late Payment Policy

For events and short‑term bookings, payment is due immediately upon invoice.

Where credit terms are expressly agreed in writing, invoices must be paid within a maximum of 14 days from the invoice date.

Invoices not paid within the agreed period may be subject to a 10% surcharge, representing our standard non‑discounted rate. Where payment exceeds 30 days overdue, all outstanding invoices shall become immediately payable.

  1. Liability

Nothing in these Terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence;
  • Fraud or fraudulent misrepresentation; or
  • Any liability which cannot be excluded under English law.

Subject to the above, we shall not be liable for:

  • Incidents occurring outside the Lifeguarded Area;
  • Losses arising from inaccurate or incomplete information provided by the Client;
  • Loss or damage to personal property during the event, unless caused by our negligence.
  1. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure results from events beyond our reasonable control, including but not limited to severe weather, venue closure, illness, or emergencies.

  1. Insurance

We maintain appropriate public liability and employer’s liability insurance for the services we provide.

  1. Data Protection

We process personal data in accordance with our Privacy Policy and applicable UK data protection legislation, including the UK GDPR. Our Privacy Policy forms part of these Terms and Conditions and is available on our Website.

  1. Governing Law

These Terms and any agreement entered into under them shall be governed by and construed in accordance with English law and subject to the non‑exclusive jurisdiction of the English courts.

  1. Intellectual Property

All content on this Website, including text, graphics, logos, and images, is the property of Loan A Lifeguard Ltd and is protected by copyright laws.

You may print or download extracts for personal, non‑commercial use only, provided the Website is acknowledged as the source. No content may be reproduced, distributed, or commercially exploited without our prior written consent.
